Please be sure to carefully read and understand all the rights and restrictions set forth in this User Agreement (hereinafter referred to as this "Agreement"). Unless you accept the terms of this Agreement, you have no right to download, install, or use the "Pinyin Typing Master" mobile software and its related services. Once you install, copy, download, access, or otherwise use this software product, you will be deemed to have accepted this Agreement, which means you agree to be bound by all terms herein. If you do not agree to the terms of this Agreement, please do not install, copy, or use this software.
This Agreement is a legal agreement between the user and Fuzhou High-tech Zone Daimajiang Technology Co., Ltd. (hereinafter referred to as "Daimajiang Tech") regarding the user's downloading, installation, use, and copying of the "Pinyin Typing Master" mobile software (hereinafter referred to as "this software") that accompanies this Agreement.
All intellectual property rights in this software, as well as all information content related to this "software", including but not limited to: text expressions and combinations thereof, icons, decorations, images, charts, colors, interface design, layout frameworks, related data, auxiliary programs, or electronic documents, are owned by Daimajiang Tech and are protected by copyright law, international copyright treaties, and other intellectual property laws and regulations.
2.1 Download, Installation, and Use: This software is free software. Users may download, install, and use this software for non-commercial purposes without quantity limitation.
2.2 Copying, Distribution, and Dissemination: Users may copy, distribute, and disseminate this software product for non-commercial purposes without quantity limitation. However, each copy, distribution, and dissemination must be complete and authentic, including all software, electronic documentation, copyrights, and trademarks related to this software product, as well as this Agreement.
3.1 Prohibition of Reverse Engineering, Decompilation, and Disassembly: Users shall not reverse engineer, decompile, or disassemble this software product, nor modify any resources compiled within the program files. Except as expressly permitted by laws or regulations, users must comply with the restrictions of this Agreement.
3.2 Individual Authorization: Commercial sales, copying, or distribution, including but not limited to software sales, pre-installation, bundling, etc., must obtain written authorization and permission from Daimajiang Tech.
3.4 Rights Reserved: All other rights not expressly granted in this Agreement remain with Daimajiang Tech. Users must obtain Daimajiang Tech's written consent before exercising any other rights.
4.1 Software Modification and Upgrade: Daimajiang Tech reserves the right to provide users with modified or upgraded versions of this software at any time. After the user confirms, the software will be upgraded and updated, generating corresponding data traffic fees, which will be charged by the carrier.
4.2 Bundled Products: To provide more extended features, Daimajiang Tech may bundle other related Daimajiang Tech products with this software for users to choose to download and install.
4.3 This software does not contain any malicious code intended to damage user mobile communication device data or capture user private information; it does not contain any code for tracking or monitoring users; it does not collect personal information about users' use of other software, documents, etc., and does not leak user privacy.
4.4 Users shall use this software in compliance with laws and this Agreement. Users have no right to engage in the following acts, including but not limited to:
(1) Deleting or altering all rights management electronic information on this software;
(2) Intentionally circumventing or destroying the technical measures taken by the copyright owner to protect the copyright of this software;
(3) Using this software to mislead or deceive others;
(4) Violating national regulations by deleting, modifying, adding to, or interfering with computer information system functions, causing the computer information system to fail to operate normally;
(5) Without permission, entering a computer information network or using computer information network resources;
(6) Without permission, deleting, modifying, or adding to computer information network functions;
(7) Without permission, deleting, modifying, or adding data and application programs stored, processed, or transmitted in a computer information network;
(8) Disrupting the normal operation of this software system or website, intentionally spreading destructive programs such as computer viruses;
(9) Any other acts that endanger computer information network security.
4.5 For this software product downloaded from sites not designated by Daimajiang Tech, or obtained from media not issued by Daimajiang Tech, Daimajiang Tech cannot guarantee whether the software is infected with viruses or hides disguised Trojan programs or hacker software. Using such software may lead to unpredictable risks. Users are advised not to download, install, or use such software easily. Daimajiang Tech assumes no legal liability arising therefrom.
4.6 Any content that users publish, upload, or transmit using this software shall comply with current national laws and regulations, and shall not contain the following content:
4.6.1 Content that violates the basic principles established by the Constitution; or contains other content prohibited by laws and administrative regulations;
4.6.2 Content that endangers national security, leaks state secrets, subverts state power, or undermines national unity;
4.6.3 Content that damages national honor and interests, or attacks the Party and government and their leaders;
4.6.4 Content that incites ethnic hatred or ethnic discrimination, or undermines ethnic unity;
4.6.5 Content that incites illegal assemblies, associations, processions, demonstrations, or mass disturbances to social order, or activities in the name of illegal civil organizations;
4.6.6 Content that undermines national religious policy, or promotes cults or feudal superstition;
4.6.7 Content that spreads rumors or false information, disrupts social order, or undermines social stability;
4.6.8 Content that spreads reactionary, obscene, pornographic, gambling, violent, murderous, terrorist content, or incites crime;
4.6.9 False, harassing, insulting, intimidating, injurious, provocative, or vulgar information;
4.6.10 Content that goes against traditional Chinese virtues, social morality, ethics, and socialist spiritual civilization;
4.6.11 Content that promotes racial discrimination, or undermines the unity of the country, nation, or region;
4.6.12 Content that infringes upon the portrait right, name right, reputation right, privacy right, or other personal rights of others;
4.6.13 Content that infringes upon any other third party's patent right, copyright, trademark right, reputation right, or any other legitimate rights and interests.
4.6.14 Other content prohibited by laws, administrative regulations, and national provisions.
4.7 With respect to content that users publish, upload, or transmit through this software, Daimajiang Tech has the right to conduct necessary supervision and review in accordance with relevant national laws and regulations and other guidelines of this Agreement. If users violate any of the above provisions while using this software, or if complaints are received from users, Daimajiang Tech has the right to require users to correct such behavior or directly take all necessary measures (including but not limited to modifying or deleting content uploaded and published by users, suspending or terminating users' right to use this software's services) to mitigate the impact caused by users' improper behavior.
4.8 If users upload, publish, or transmit content prohibited by national laws and administrative regulations, such as reactionary or pornographic content, through this software, the system's records of this software may serve as evidence of users' violation of law. Any claims brought by third parties or any damages or losses arising from users' uploading, publishing, or transmitting such content through this software shall be borne entirely by the users. If Daimajiang Tech suffers losses due to users' behavior, users shall be liable for full compensation (including but not limited to various compensation fees, litigation agency fees, and other reasonable expenses incurred thereof).
4.9 Privacy Protection
4.9.1 Daimajiang Tech has established strict rules for handling user-uploaded information and security protection measures to ensure that user information is not collected beyond the purpose and scope, to ensure the security of user-uploaded information, and to ensure that user-uploaded information is not misused. Except with the user's explicit consent or as clearly provided by law, Daimajiang Tech will not provide user-uploaded files and information to any third party.
4.9.2 Daimajiang Tech has established the following four privacy protection principles to guide how we handle issues related to user privacy and user information in our products:
(1) Using the information we collect to provide users with valuable products and services.
(2) Developing products that meet privacy standards and privacy practices.
(3) Making personal information collection transparent and supervised by authoritative third parties.
(4) Doing our best to protect the information we hold.
4.9.3 Daimajiang Tech has established strict rules for handling user-uploaded information and security protection measures to ensure that user information is not collected beyond the purpose and scope, to ensure the security of user-uploaded information, and to ensure that user-uploaded information is not misused. Except in the following circumstances, Daimajiang Tech will not collect or provide user-uploaded materials and user information to any third party:
(1) With the prior authorization of the user;
(2) As required by laws, regulations, legal procedures, or mandatory requirements of competent government authorities;
(3) In compliance with relevant service terms or use agreements;
5.1 Service Acquisition: The Pinyin Typing Master VIP membership service is a paid service. You can purchase it by paying the corresponding service fee; you can also obtain the service through marketing activities, gift cards, and other means recognized by the Company. When obtaining the Pinyin Typing Master VIP membership service, you shall comply with laws and regulations and the terms of this Agreement, and shall not infringe upon the legitimate rights and interests of third parties or the Company. You shall not obtain VIP membership services by yourself (or assist others) through the following means:
(1) For commercial or other non-personal use purposes;
(2) Registering a Pinyin Typing Master account using false information or impersonating others;
(3) Using any automatic programs, scripts, or software such as robot software, spider software, or crawler software;
(4) Without permission from the Company, obtaining VIP membership services by borrowing, renting, selling, sharing, or transferring;
(5) By improper means or in a manner that violates the principle of good faith (such as exploiting rule loopholes, exploiting system loopholes, abusing membership status, black industry, speculation, etc.);
(6) By exploiting or undermining the Pinyin Typing Master VIP membership service rules.
The Company hereby declares that any act of selling, renting, or similarly transferring the Pinyin Typing Master VIP membership without the Company's express authorization constitutes an infringement, and we reserve the right to pursue legal liability in accordance with the law.
5.2 Basic Principles of Service Use
(1) When using the Pinyin Typing Master VIP membership service, you shall comply with laws and regulations and other normative documents, observe public order, respect social morality, and shall not endanger network security or use the network to engage in activities that endanger national security, honor, and interests; incite subversion of state power or overthrow of the socialist system; incite separatism or undermine national unity; promote terrorism or extremism; promote ethnic hatred or discrimination; spread violent or pornographic information; create or spread false information to disrupt economic or social order; or infringe upon others' reputation, privacy, intellectual property rights, or other legitimate rights and interests. If you engage in any of the above behaviors, the Company has the right to terminate the provision of the Pinyin Typing Master VIP membership service to you.
(2) Unless otherwise agreed by both parties, the Company grants you a personal, non-exclusive, non-commercial, revocable, and time-limited license to use the Pinyin Typing Master VIP membership service, meaning you may only use the VIP membership service for personal, non-commercial purposes.
(3) You understand and agree that you shall not provide your account to others for use in any manner, including but not limited to transferring, renting, lending, sharing, or selling it for purposes including but not limited to livestreaming, recording, viewing, uploading, or participating in activities. Otherwise, you shall bear all legal consequences and responsibilities arising therefrom. Losses caused by the above behavior, such as account loss, leakage, tampering, or theft, or losses caused by abnormal account status or account suspension due to multi-terminal login, different-location login, or similar situations that trigger the Company's security risk control, shall also be borne by you, and the Company reserves the right to decide whether to suspend or terminate services to you based on your breach.
(4) We remind minors to make good use of online learning when using membership services.
5.3 Notice of Service Changes
To facilitate your awareness of information related to this Agreement and the VIP membership service, you agree that the Company has the right to notify you through one or more means, including web page publication, page prompts, pop-ups, message notifications, public account notifications, in-site messages, and contact information you have reserved (such as SMS, email, etc.). Such notice shall be deemed successfully delivered to you upon sending by the Company. Where multiple notification methods coexist, the delivery time shall be the earliest of the above-mentioned methods. The content of such notifications may have a material favorable or unfavorable effect on you; please ensure your contact information is valid and pay attention to the relevant notifications in a timely manner.
6.1 Daimajiang Tech will continuously improve product functions to provide users with a better product experience. Due to differences in user mobile phone hardware and software, this feature cannot guarantee absolute timeliness, accuracy, or completeness in technical terms.
6.2 The user acknowledges that they are aware of all functions of this software and the necessary operations performed by Daimajiang Tech to implement such functions, and that they voluntarily choose to use this software and related services based on their own needs. All risks and consequences arising from the use of this software and related services shall be borne entirely by the user. Daimajiang Tech assumes no responsibility.
6.3 This software has undergone detailed testing, but cannot be guaranteed to be fully compatible with all software and hardware systems, nor can it be guaranteed to be completely error-free. If incompatibility or software errors occur, users may send feedback emails to Daimajiang Tech's customer service email (daimajiang@163.com) to obtain technical support. If the compatibility issue cannot be resolved, users may delete this software.
6.4 The user acknowledges that they understand that Daimajiang Tech makes no express or implied commitment or guarantee regarding the timeliness, accuracy, completeness, ability to achieve intended effects, or ability to meet user needs of this software's various functions. If users believe this software has shortcomings, they may close related functions or uninstall this software at any time.
6.5 To the maximum extent permitted by applicable law, Daimajiang Tech assumes no responsibility for any damages and risks arising from the use or inability to use this software, including but not limited to direct or indirect personal damage, loss of commercial profits, business interruption, loss of commercial information, or any other economic loss.
6.6 Daimajiang Tech assumes no responsibility for losses caused by telecommunications system or Internet network failures, computer failures or viruses, information damage or loss, computer system issues, or any other force majeure. If users encounter related issues, please notify Daimajiang Tech in a timely manner, and Daimajiang Tech will take corresponding measures to promptly resolve the issues reported by users.
6.7 If the user violates the provisions of this Agreement, Daimajiang Tech has the right to take measures including but not limited to suspending the use license, ceasing service provision, restricting use, and pursuing legal action.
7.1 This Agreement shall be governed by the laws of the People's Republic of China.
7.2 Any disputes arising from or related to this Agreement shall be resolved through friendly negotiation; if negotiation fails, either party may file a lawsuit with the people's court at the location of the defendant.
8.1 If any provision of this Agreement is found, for any reason, to be wholly or partially invalid or unenforceable, or to violate any applicable law, such provision shall be deemed deleted, but the remaining provisions of this Agreement shall remain valid and binding.
8.2 Daimajiang Tech has the right to modify this Agreement at any time in accordance with changes in relevant laws and regulations, the Company's operating conditions, and business strategies, and shall attach it to the new version of the software. In the event of a dispute, the latest agreement text shall prevail. If you do not agree with the changes, you may delete this software yourself. If you continue to use this software, you are deemed to accept the changes to this Agreement.
8.3 Daimajiang Tech reserves the right to interpret and modify this Agreement to the maximum extent permitted by law.
